Estate Planning Lawyer Queens: Wills, Trusts, Probate

What You Sign Now Controls What Happens Later

You may already know who should receive your home, savings, or business. The question is whether your will, beneficiary forms, and the way your property is owned will actually carry that out, and who can step in if you are unable to act for yourself.

Boyer Law Firm drafts New York wills and trusts, along with the powers of attorney and health care directives that go with them. A Queens estate planning lawyer at the firm also represents executors and administrators in probate and estate administration, so the legal work may begin with a plan or with an estate that now needs to be opened.

How Long Does Probate Take in Queens, NY?

There is no single probate timetable in Queens. The time needed to receive letters testamentary and complete the estate depends on whether the petition establishes jurisdiction, the original will is available, all required persons are accounted for, and no one disputes the will or the proposed executor.

  • Waivers or citations. A distribute may sign a waiver and consent. Otherwise, the court issues a citation that has to be served before the case proceeds.
  • Unknown or missing distributes. The filing may require an affidavit documenting a diligent search. Court checklists identify sources such as vital records, Surrogate’s Court files, and conversations with relatives.
  • Questions about the will. An interested party may examine the attesting witnesses and the person who prepared the will before filing objections. Formal objections then move the matter into contested probate and broader discovery.
  • A missing original. A copy is not treated like an original will. Probating a lost or destroyed will requires additional proof and may draw objections that an ordinary filing would not.
  • Property and tax work. A sale, transfer, estate tax return, or required release of lien adds work beyond obtaining letters. New York estate tax returns and payment are generally due nine months after death when the filing threshold is met.

An uncontested filing with a complete petition and signed waivers avoids several of these delay points, but it does not produce a guaranteed completion date. A Queens probate lawyer can identify which issue is likely to control your particular timetable.

Estate Planning Lawyer Queens: Matters We Handle

Wills and Living Trusts

New York will execution requires careful signing and two attesting witnesses. Boyer Law Firm also addresses trust terms, execution, and the assets that need to be transferred into the trust.

Powers of Attorney and Health Care Proxies

The firm prepares financial and health care documents for the authority you want to grant. Properly executed older powers of attorney remain valid, but their scope should still match your present needs.

Estate Tax and Business Succession

Business interests, ownership agreements, and New York estate tax exposure need to be reviewed together. A succession plan also addresses who has authority to operate or transfer the company.

Probate of a Will

Boyer Law Firm prepares the probate petition, identifies the distributees, obtains waivers where available, and arranges for citation where consent is not given.

Administration Without a Will

New York law sets an order of priority for appointment when no will names an executor. The firm prepares the administration petition and addresses competing or equal rights to serve.

Small Estate Proceedings

Voluntary administration is available when qualifying personal property totals $50,000 or less. It does not administer real property held in the decedent’s name alone.

Probate Value and Estate Tax Value Are Not the Same

For a New York resident who dies in 2026, the state estate tax basic exclusion amount is $7,350,000. The available credit phases out as the New York taxable estate rises above that figure. Once the taxable estate exceeds 105% of the exclusion, or $7,717,500 in 2026, no exclusion credit remains. The federal basic exclusion amount is higher at $15,000,000 for 2026.

This calculation is not limited to property that passes through probate. An account with a named beneficiary may transfer outside Surrogate’s Court and still form part of the taxable estate. A funded revocable trust may change how an asset is administered, but it does not automatically remove the asset from the taxable estate or protect it from the creator’s creditors.

Your estate planning lawyer at Boyer Law Firm will review ownership, beneficiary designations, lifetime gifts, business interests, and tax exposure as separate parts of the plan.

What Rego Park Property Ownership Changes

If the person who died was domiciled in Rego Park, the proper venue is the Queens County Surrogate’s Court in Jamaica. The county of domicile controls the filing even when the executor, beneficiaries, or some assets are elsewhere.

The ownership form matters as much as the address. A co-op interest consists of shares in a corporation and a proprietary lease, while a condominium is deeded real property. A condo or house owned in the decedent’s name alone takes the estate outside New York’s small-estate procedure. Co-op shares are personal property, but their value and title still decide whether voluntary administration is available and whether a full probate or administration proceeding is required.

A Rego Park estate attorney can trace how the home, accounts, and other property are titled before choosing the proceeding. This is estate and probate work, not representation for a purchase or sale closing.

Why Work With Boyer Law Firm on a Queens Estate Plan

New York-Licensed Counsel

Francis M. Boyer is admitted to practice in New York. That matters when planning documents and Surrogate’s Court filings are governed by New York law.

Planning and Administration Together

The firm handles documents created during life and the court proceedings used after death. Asset ownership is reviewed with both stages in mind.

Cross-Border Estate Perspective

Francis M. Boyer holds board certification in international law from The Florida Bar and advises on international probate and estate planning when assets, heirs, or documents cross borders.

English, Spanish, French, and Turkish

Francis works in all four languages. Direct communication is useful when a Queens estate includes relatives abroad or documents issued in another country.

What Happens After You Contact the Firm

The route depends on whether you are creating a plan or administering an estate, but both start with ownership and authority rather than a list of forms.

1. Define the Legal Job

The first review separates planning, probate, administration, and voluntary administration. It also identifies any immediate tax filing, property, or court issue.

2. Map the Assets and People

The firm reviews title, beneficiary designations, approximate values, family relationships, and business interests. Those facts determine what enters the estate and who receives notice.

3. Prepare the Documents or Petition

Planning documents are drafted and executed under New York formalities. For an estate, the appropriate petition, supporting records, waivers, and proposed citation are prepared for Queens County Surrogate’s Court.

4. Complete Funding or Administration

Trust assets and beneficiary designations are updated where appropriate. In an estate, the fiduciary collects property, addresses approved debts and taxes, keeps records, and distributes what remains.

FAQs About Estate Planning and Probate in Queens

What is the difference between estate planning and probate?

Estate planning is completed during your lifetime and sets out who receives property and who may act for you. Probate is the Surrogate’s Court proceeding used after death to establish a will and appoint the executor. A plan may reduce probate, but only assets transferred by trust, beneficiary designation, joint ownership, or another non-probate method avoid the proceeding.

What do I need to probate a will in Queens?

A Queens probate filing generally requires the original will and codicils, a certified death certificate, a petition, details for every distributee, and supporting affidavits. Distributees either waive process or receive a citation. The court may request additional proof where names, addresses, family relationships, witnesses, or the will’s execution require explanation.

How much does a probate lawyer in Queens charge?

Legal fees vary with the work involved and are separate from court charges. The probate or administration filing fee is $45 for an estate under $10,000 and rises to $1,250 at $500,000 or more. Filing probate objections and demanding a jury trial each carry an additional $150 court fee. The engagement agreement should state how the legal fee is calculated and what it covers.

Is a trust better than a will in New York?

Neither document is universally better. A funded revocable trust keeps the assets transferred into it outside probate, while a will controls probate property and names an executor. A trust does not avoid court for assets left outside it, automatically reduce estate tax, or shield the creator’s property from the creator’s creditors.

What is the difference between a power of attorney and guardianship in New York?

A power of attorney is signed while you have capacity and lets you choose an agent for financial matters. An Article 81 guardianship is a court proceeding in which a judge decides whether a guardian is needed and what powers to grant. A valid power of attorney may reduce the need for guardianship, but it does not prevent every guardianship case.

Where is a Queens County estate filed?

An estate for a person domiciled in Queens is filed in the Queens County Surrogate’s Court at 88-11 Sutphin Boulevard, Jamaica, NY 11435. The court handles probate, administration, and eligible small-estate matters for the borough. Electronic filing is available through the New York State Courts Electronic Filing system, subject to the rules for the proceeding and filer.
